Welcome to SustainAI ("SustainAI," "we," "us," or "our"). We are a Texas nonprofit corporation (501(c)(3) pending). These Terms of Service ("Terms") govern your access to and use of our website at https://sustainai.global (the "Site"), along with any software, models (including the Ethos model), tools, data, or services provided by SustainAI (collectively, the "Services").

Please read these Terms carefully before using our Services. By accessing or using our Services—including participating in early access or beta testing—you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. Our collection and use of personal information is described in our Privacy Policy.

1. Eligibility & Accounts

By using our Services, you represent and warrant that you are at least 13 years of age (or the minimum age of digital consent in your country). If you register for an account or request early access on behalf of an organization or entity, you represent that you have the authority to bind that entity to these Terms.

2. Beta Testing and Early Access (Important Notice)

Parts of our Services, including the Ethos model, are currently in prototype, alpha, or beta testing phases (collectively, "Beta Services").

  • Experimental Nature: You acknowledge that Beta Services are undergoing active development, may contain bugs, errors, or inaccuracies, and may not function as intended.
  • No Guarantee of Availability: We reserve the right to modify, suspend, or discontinue Beta Services (or your access to them) at any time, for any reason, without notice or liability to you.
  • Limited Rollout: Access to Ethos and other Beta Services may begin with a small invited group before any broader public or volunteer release. Information on our Site about upcoming access does not guarantee immediate availability or a right to access.
  • Feedback: If you provide feedback, suggestions, or ideas regarding the Beta Services, you grant SustainAI an unrestricted, perpetual, worldwide, royalty-free license to use and implement that feedback without compensation to you.

3. Intellectual Property Rights

  • Our Content & Technology: Unless otherwise stated, the Services, including our website design, code, underlying AI models, algorithms, documentation, graphics, and branding (the "SustainAI IP"), are the proprietary property of SustainAI or our licensors and are protected by copyright, trademark, and other intellectual property laws.
  • Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, educational, or internal organizational purposes as intended by the platform. You may not reverse-engineer, decompile, or attempt to extract the source code or weights of our AI models without explicit written permission.

4. Acceptable Use and Prohibited Conduct

We are a mission-driven nonprofit focused on human flourishing and ethical AI alignment. You agree not to use the Services to:

  • Violate any applicable local, state, national, or international law.
  • Generate, upload, or share content that is defamatory, obscene, hateful, harassing, discriminatory, or promotes violence.
  • Infringe upon the intellectual property rights or privacy rights of any third party.
  • Deploy malware, viruses, or engage in activity that disrupts, disables, or overburdens the infrastructure of our Site or Services (e.g., scraping, DDoS attacks, or prompt-injection exploits designed to bypass safety filters).
  • Misrepresent your affiliation with SustainAI or imply that SustainAI endorses your commercial activities without a formal partnership agreement.

5. AI-Specific Disclaimers & Output Content

If you interact with our AI tools or models (such as the Ethos model), the following terms apply to any text, code, images, or other data generated by the model ("Output"):

  • No Warranty of Accuracy: AI models can generate inaccurate, incomplete, or biased information (often called "hallucinations"). You are solely responsible for reviewing and verifying the accuracy and appropriateness of any Output before relying on it.
  • Not Professional Advice: Outputs generated by our Services are for educational and informational purposes only. They do not constitute professional, legal, medical, financial, or technical advice.
  • Nature of Output: You acknowledge that due to the nature of machine learning, Outputs may not be unique across different users, and the Services may generate the same or similar output for other parties.

6. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUSTAINAI DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SUSTAINAI, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless SustainAI and its directors, officers, employees, agents, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your misuse of any Output.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles, except where mandatory consumer protection laws in your jurisdiction require otherwise.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
