Welcome to SustainAI ("SustainAI," "we," "us," or "our"). We are a Texas nonprofit corporation recognized by the IRS as a 501(c)(3) public charity. These Terms of Service ("Terms") govern your access to and use of our website at https://sustainai.global (the "Site"), along with any publicly shared research materials, documentation, datasets, model-related information, software, or other content we make available (collectively, the "Services").
Please read these Terms carefully before using our Services. By accessing or using the Site or any Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services. Our collection and use of personal information is described in our Privacy Policy.
No professional relationship. Visiting the Site, reading our materials, downloading datasets, or contacting us does not create an attorney-client, advisor-client, employment, partnership, or other professional relationship with SustainAI.
1. Eligibility & Accounts
By using our Services, you represent and warrant that you are at least 13 years of age (or the minimum age of digital consent in your country). If you register for an account or communicate with us on behalf of an organization or entity, you represent that you have the authority to bind that entity to these Terms.
2. Research Materials; Informational Use Only
The Site and any research materials we publish — including articles, documentation, transparency notes, evaluation summaries, training methodology descriptions, and datasets — are provided for informational and research purposes only.
- Not advice: Nothing on the Site or in related materials constitutes professional, career, business, financial, legal, medical, investment, or any other form of advice. You should not rely on these materials for decision-making.
- Experimental nature: Research models and datasets associated with SustainAI (including Ethos ESI) are experimental research artifacts. They may contain errors, biases, or incomplete information and are provided "as is" without warranties of any kind.
- Private model access: Ethos ESI and similar research models are not publicly released for general use. Any access for SustainAI team members or selected research collaborators is governed by separate written agreements in addition to these Terms. Information on the Site does not create a right to model access.
- Datasets and downstream use: If you download or use any dataset or derived materials we publish, you assume all responsibility for downstream training, deployment, and use, subject to the applicable license and these Terms. SustainAI is not liable for how third parties use or misuse such materials.
- Feedback: If you provide feedback, suggestions, or ideas regarding our research or Services, you grant SustainAI an unrestricted, perpetual, worldwide, royalty-free license to use and implement that feedback without compensation to you.
3. Intellectual Property Rights
- Our Content & Technology: Unless otherwise stated, the Services, including our website design, code, research documentation, branding, and any proprietary models or algorithms (the "SustainAI IP"), are the proprietary property of SustainAI or our licensors and are protected by copyright, trademark, and other intellectual property laws. Publicly released datasets or documentation may be subject to a separate license stated with those materials.
- Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and publicly shared materials for personal, educational, or internal research purposes as intended. You may not reverse-engineer, decompile, or attempt to extract source code or model weights of any SustainAI research model without explicit written permission, except as expressly allowed by a published license for a specific artifact.
4. Acceptable Use and Prohibited Conduct
We are a mission-driven nonprofit focused on public-benefit research. You agree not to use the Services to:
- Violate any applicable local, state, national, or international law.
- Generate, upload, or share content that is defamatory, obscene, hateful, harassing, discriminatory, or promotes violence.
- Infringe upon the intellectual property rights or privacy rights of any third party.
- Deploy malware, viruses, or engage in activity that disrupts, disables, or overburdens the infrastructure of our Site or Services (e.g., scraping or DDoS attacks).
- Misrepresent your affiliation with SustainAI or imply that SustainAI endorses your commercial activities, products, or advice without a formal partnership agreement.
5. AI-Specific Disclaimers & Output Content
If you somehow interact with any SustainAI research model or AI-related materials, or use datasets derived from our research, the following terms apply to any text, code, images, or other data produced ("Output"):
- No Warranty of Accuracy: AI systems can generate inaccurate, incomplete, or biased information. You are solely responsible for reviewing and verifying the accuracy and appropriateness of any Output before relying on it.
- Not Professional Advice: Outputs and research materials are for educational and informational purposes only. They do not constitute professional, career, business, legal, medical, financial, or technical advice.
- Nature of Output: You acknowledge that due to the nature of machine learning, Outputs may not be unique across different users, and similar content may be generated for other parties.
- Human responsibility: Humans and human institutions remain solely responsible for decisions, deployments, and any harm arising from use of Outputs or derived systems.
6. Disclaimer of Warranties
OUR SERVICES — INCLUDING THE SITE, RESEARCH MATERIALS, DATASETS, DOCUMENTATION, AND ANY RESEARCH MODELS OR RELATED ARTIFACTS — ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE STATE OF TEXAS AND APPLICABLE LAW, SUSTAINAI DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF THE STATE OF TEXAS AND APPLICABLE LAW, IN NO EVENT WILL SUSTAINAI, ITS DIRECTORS, EMPLOYEES, PARTNERS, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, RESEARCH MATERIALS, DATASETS, OR OUTPUTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
8. Indemnification
You agree to defend, indemnify, and hold harmless SustainAI and its directors, officers, employees, agents, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your download or use of datasets or research materials, your violation of these Terms, or your misuse of any Output.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles, except where mandatory consumer protection laws in your jurisdiction require otherwise.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
